Boy, when physicians tried to open pharmacies to provide convenience for patients, Stark III laws prohibited this. Conflict of interest, they said. Inappropriate financial gain from referrals, they said.

So why is it allowed now?

Beats me. One Medical physicians owned by Amazon refer patients to a pharmacy owned by Amazon. Should be illegal under the same law. Double standards in America? Who would have thought. 🙄

The technical answer is a combination of corporate practice of medicine structures (MSO/PC) and the Stark law employment exception.

Pharmacy kiosks are a great idea, but Amazon bought a seriously financially distressed asset in One Medical that won’t be turned around because of this. Too early to be declaring any victory here.
